Terms and Conditions of Sale

By using NewNest (“NewNest”, “we”, “us”, “our”) or purchasing through our assisted buying and forwarding service, you (“Customer”, “you”, “your”) agree to the following Terms and Conditions (“Terms”).

1. Nature of Service

1.1 NewNest provides an assisted purchase and forwarding service. This means:

  • You authorize us to purchase items on your behalf from third-party retailers, suppliers, or marketplaces (“Third-Party Sellers”).

  • We handle the purchase and arrange for the items to be delivered to you.

  • We are not the manufacturer, retailer, or supplier of the goods.

1.2 Accordingly, NewNest:

  • Does not design, produce, or manufacture any products.

  • Makes no guarantees regarding product quality, safety, fitness for purpose, or compliance.

  • Is not responsible for product defects, recalls, warranties, or representations made by Third-Party Sellers.

1.3 Our responsibility is limited to:

  • Accurately following your purchase instructions.

  • Processing payments to the Third-Party Seller.

  • Forwarding and shipping items to your nominated address.

2. Warranties, Product Quality, and Liability

2.1 NewNest makes no representations or warranties regarding products purchased through our service, including but not limited to:

  • Quality, durability, or performance.

  • Accuracy of descriptions or specifications.

  • Non-infringement of third-party rights.

2.2 To the fullest extent permitted by law:

  • NewNest is not liable for any loss, damage, injury, or cost related to the use or quality of the purchased products.

  • All warranties and liabilities regarding the goods rest solely with the Third-Party Seller or manufacturer.

2.3 Our liability is strictly limited to our service fees for the relevant order and to the performance of our assisted buying and forwarding service.

3. Refunds and Returns

3.1 As NewNest is not the actual seller of the products:

  • We cannot process returns, exchanges, or product refunds.

  • Any return, refund, or warranty claim must be made directly to the Third-Party Seller or manufacturer.

3.2 Refunds of NewNest service fees will only be issued as required by applicable law.

4. Orders, Payments, and Title

4.1 Orders are fulfilled based on the information you provide. NewNest is not responsible for errors resulting from inaccurate, incomplete, or unclear instructions.

4.2 Title to goods passes directly from the Third-Party Seller to you. NewNest does not take ownership of the products.

4.3 Orders are subject to product availability. If a product is unavailable, we will refund your payment (excluding service fees already rendered).

4.4 All payments must be made in full before purchase or shipment is processed.

5. Delivery and Risk

5.1 Delivery timeframes are estimates only and are not guaranteed. NewNest is not responsible for delays caused by postal services, couriers, customs, or other factors beyond our control.

5.2 Risk in the goods transfers to you once they are dispatched by the Third-Party Seller or handed to the shipping carrier.

5.3 You are responsible for any loss or additional costs resulting from incorrect or incomplete delivery addresses.

6. Customs, Duties, and Import Taxes

6.1 For international orders, you are considered the importer of record and are responsible for all customs duties, import taxes, clearance fees, and compliance with local import regulations.

6.2 NewNest does not charge or collect Goods and Services Tax (GST) on behalf of any authority.

6.3 Customs duties and import taxes are separate from our service fees and must be paid directly to the relevant authorities or delivery agents.

6.4 NewNest is not liable for any customs delays, holds, or additional charges imposed by border authorities.

7. Limitation of Liability

To the maximum extent permitted by law:

  • NewNest is not responsible for any indirect, incidental, or consequential losses (including loss of profit, data, or business interruption).

  • Our liability is limited solely to direct losses arising from our failure to perform our service with reasonable care and skill.

  • Under no circumstances will our liability exceed the total service fees paid for the affected order.

8. General Provisions

8.1 All prices are quoted in Australian Dollars (AUD) and exclude GST unless stated otherwise.

8.2 NewNest reserves the right to decline or cancel orders (including suspected fraud, pricing errors, or stock unavailability).

8.3 Website information is provided in good faith and may contain errors. We make no guarantees regarding completeness or accuracy.

9. Disclaimer

NewNest acts only as a purchasing and forwarding facilitator. We are not the seller or manufacturer of the products you purchase.
We are not responsible for product performance, safety, or compliance. Our role is solely to assist with purchase and delivery logistics on your behalf.
